Judge Tosses Governor Ron DeSantis’ Order Prohibiting Masks In Schools
Florida governor Ron DeSantis is not getting his way when it comes to banning masks in schools.
As we reported, DeSantis said that there would be consequences if school districts enforced masks upon their students and faculty. However, a Florida judge has ruled school districts in the state can require students to wear masks.
Leon County Circuit Judge John C. Cooper’s decision followed a four-day trial.
“The actions of the defendants (DeSantis) do not pass constitutional muster,” Cooper said. “They seek to deprive the school boards in advance.”

“The law expressly permits school boards to adopt policies regarding the health care of students, such as a mask mandate, even if a parent disagrees,” Cooper added. “Parents’ rights are very important, but they are not without some reasonable limitations.”
The judge made his decision based on scientific evidence and other factors.
“The evidence clearly demonstrates that the recommendation by the CDC for universal masking… represents the overwhelming consensus of scientists and the medical community,” Cooper said. “The evidence submitted by the defendants [Governor] I think reflects a minority of medical opinions.”
