Florida Man Fights For Custody Of Daughter After Child’s Mother Allegedly Claimed She Died When Actually Placed Into Adoption

A heartbroken father is tirelessly fighting to obtain custody of his daughter whom the mother claimed died when she really placed the child up for adoption.

According to ABC Action News, Brandon Marteliz is going into his third year of a custody battle for his daughter Amiya.

Marteliz claimed that he texted his child’s mother a day before delivery to ask if she was going to the hospital; yet she never answered. Court documents state that the mother placed the child up for adoption a day after birth.

She told Marteliz another narrative, stating their daughter died of sudden infant death syndrome.

Three weeks post labor, the unidentified woman texted Marteliz saying “I got the baby”. He requested the opportunity to see their child, but it was denied and ignored. A Child Protective Services Agent called him to inform him that Amiya was being cared for by an adoption agency.

The agency is refusing to hand Amiya over to Marteliz, arguing that the mother authorized it, and he didn’t pay “a fair and reasonable amount of living and medical expenses” associated with the pregnancy and birth. With the mother not notifying him of their child’s birth, he was also unable to sign the putative father registry that “permits a man alleging to be the unmarried biological father of a child to preserve his right to notice and consent in the event of an adoption.”

“There’s a real problem, and good fathers are losing rights and losing time,” Marteliz said. The father and his attorney are still relentlessly fighting to bring Amiya home.
