A tragic shooting took place on a New York subway and left a man in critical condition. Despite the violent nature of the crime, according to the Brooklyn District Attorney’s office, the shooter will not be facing charges because they believe he acted in self-defense.

Yesterday, Younece Obuad, 32, shot Dajuan Robinson, 36, in the head after the two got into an altercation on a Brooklyn train.

In the videos captured by people on the train at the time of the incident, Robinson can be heard cursing at Obuad and his female companion saying, “F*** your kind. F*** your race. F*** you.” “You think you’re gonna beat up cops? I’ll beat you up.”

The altercation quickly took a left turn when Obuad and Robinson began to fight and Robinson pulled out a weapon. The two then continued to wrestle before Obuad grabbed the weapon and shot Robinson in the head.

Robinson is currently in critical condition. Obuad was arrested on the scene, but has since been released and will not face charges.

“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ Oren Yaniv, a spokesman for the Brooklyn District Attorney’s Office, said in an e-mailed statement.

“The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter.”
