Same-Sex Marriages In Danger Of Being Overturned After Supreme Court Overturned Right To Abortion

Same-Sex Marriages In Danger Of Being Overturned After Supreme Court Overturned Right To Abortion

After over 43 years, the ruling of Roe v. Wade was overturned by the Supreme Court, allowing the courts to do the same with other previous rulings. Thuggish has made it possible for several states to ban access to safe abortions.

Justice Clarence Thomas celebrated this morning, stating, “In future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell.”

Obergefell v. Hodges was the landmark civil rights case that ruled same-sex couples were legal throughout the United States.

Overturning this ruling would devastate millions of families by denying healthcare to the dependents of gay insurance recipients, the wages and retirement benefits for a deceased spouse, the ability to take leave when a spouse is sick or injured, and marital tax deduction, IRA, and Social Security benefits, and more.

After today’s ruling, the liberal justices wrote, “Either the mass of the majority’s opinion is hypocrisy, or additional constitutional rights are under threat. It is one or the other.”

The court, in a 6-3 ruling powered by its conservative majority, upheld a Republican-backed Mississippi law that bans abortion after 15 weeks. The vote was 5-4 to overturn Roe, with Chief Justice John Roberts writing separately to say he would have upheld the Mississippi law but not taken the additional step of erasing the precedent altogether.

The justices held that the Roe v. Wade decision that allowed abortions performed before a fetus would be viable outside the womb – between 24 and 28 weeks of pregnancy – was wrongly decided because the U.S. Constitution makes no specific mention of abortion rights.
