Jussie Smollett Attends Illinois Appeal Court Requesting His Conviction Be Tossed Out
Jussie Smollett and his team are still fighting back to get him out of his 150 day stay in jail. Tuesday, his lawyers argued that an Illinois appeals court should toss out convictions for his controversial 2019 staged attack.
His team believes that the public’s perception of the actor changed once police said he wasn’t the victim of a crime but instead committed a crime.
Their argument is that “public outrage against the defendant cannot overrule the rule of law”.

Their main question posed was “is it fair?” In a list of his teams arguments his lawyers say that the 2021 trial was a violation against his fifth amendment protections against double jeopardy.
The written appeal states that Smollett already paid his dues by doing community service and paying a $10,000 bond as part of a previous deal.
“If Mr. Smollett’s convictions are allowed to stand, this case will set a dangerous precedent by giving prosecutors a second bite at the apple any time there is dissatisfaction with another prosecutor’s exercise of discretion,” the appeal says.
If the appeal fails, Jussie will have to continue his 150 sentence.
