Yesterday, Olabinjo and Abimbola Osundairo were charged with battery for assaulting the 36-year-old actor.
During the attack, the perpetrators poured a bleach like substance on him and tied a rope around his neck while hurling racial epitaphs and homophobic slurs.
But police said the brothers, who were in the area and were extras on “Empire” are no longer suspects in the case.
“Due to new evidence as a result of today’s interrogations, the individuals questioned by police in the ‘Empire’ case have now been released without charging and detectives have additional investigative work to complete,” a Chicago Police department’s representative said in a statement.

So far, the police maintain the Jussie Smollett is being co-operative with the investigation and is still being treated as the victim of a hate crime.
